Prolific thief gets ASBO ban

A prolific shoplifter has been banned from entering four shops in Alfreton and Somercotes as part of an ASBO.

Chesterfield magistrates’ court heard on Monday, March 17, how James Mason, 36, of Main Road, Jacksdale, is currently serving a 28 day custodial sentence for theft and breaches of a conditional discharge and a suspended sentence and the CPS has now successfully applied for a two year anti-social behaviour order with bans.

Prosecuting solicitor Bill Taylor said: “Mason has an extensive record for dishonesty and is a prolific thief at shops and has been convicted for a number of shop thefts. Part of the reason is that he is a drug-user.”

Mr Taylor explained Pc Chris Anthony has come into contact with the defendant when he has had drugs or his demeanour was such that he appeared to have taken drugs and he said he can lose control.

The court heard Amber Valley Shopwatch members have raised concerns about Mason and these included two Co-op shops at Leabrooks and Somercotes and the Boots at Alfreton and the Wilkinson’s at Alfreton.

Mr Taylor added: “The purpose of the ASBO is to allow people to get on with their business and that certain shops should be protected.”

Magistrates imposed a two year ASBO with the conditions that Mason does not cause harassment in the concerned areas and that he is banned from entering the Co-op at Leabrooks, the Co-op at Somercotes, Wilkinson’s at Alfreton and Boots at Alfreton.

The ASBO also bans him from entering certain areas in Alfreton and Somercotes except when using public transport through Somercotes and visiting a Job Centre in Alfreton. Magistrates warned Mason, who accepted the ASBO, that any breach could result in custody.
