Man guilty of car sex act

A man has been found guilty of exposure after he was caught performing a sex act in a car in Cotmanhay.

Anthony Cook, 44, Holbrook Road, Heanor, was arrested on August 8 after reports from a passer-by that he was performing the act by the Awsworth Road junction.

He told Derby magistrates on Friday (October 11) that on the day he was returning from his girlfriend’s address in Kirk Hallam to Heanor at around 1.30pm, when passing the Aldi store in Heanor Road the car started to run out of petrol.

He claimed to have turned right down Factory Lane before rolling to a stop in Cotmanahay Road.

Defending for Cook, John Last told the court the 44-year-old was desperate to use the toilet and was urinating into an empty Jerry can when a witness and her three children passed the vehicle at around 1.45pm.

But the witness, who gave evidence via a video link, was resolute when questioned by Mr Last.

“I know what I saw,” she said, when asked whether she could have been mistaken. She described that Mr Cook was touching himself inappropriately.

Derby magistrates said that Cook’s alibi was implausible and found him guilty of exposure.

He was given unconditional bail and told to appear again at the court on November 1 for sentencing.
