Chesterfield magistrates’ court heard on Monday how David Dixon, 52, confronted Stephen House and accused him of parking in a private drive on Hallfieldgate Lane, Shirland.

Becky Allsop, prosecuting, said: “Stephen House’s wife had an injured leg and was in plaster so he reversed into a drive to help her out. He returned to the car to park in an allocated bay when he heard a voice and there was a smell of alcohol.”

Dixon, formerly of Chesterfield Road, Shirland, approached Mr House, according to Mrs Allsop, and accused Mr House’s wife of abusing his wife and said he could not park in the drive because it was private. Mrs Allsop added Dixon punched Mr House in the ear and Mr House hit back but Dixon punched him again. Dixon grabbed Mr House around the neck, according to Mrs Allsop, bit him, stood on his foot, scratched his face and tried to bite his arm and as Mr House hit back Dixon punched him in the chest. The court heard Dixon also threatened and swore at Mr House’s wife.

Dixon, of Leabrooks Road, Somercotes, was found guilty of assault and threatening behaviour after a trial. Defence solicitor Peter Jones said Dixon’s ex and her daughter were away during the incident in July, last year, and he was house-sitting and was aware of a parking dispute. Dixon received 16 weeks’ custody suspended for 12 months with 150 hours’ unpaid work. He must pay £1,244.70 in costs, charges and compensation. He was also given a two-year restraining order.
