Chesterfield magistrates’ court heard on July 18 how David Julian Ward, 39, stole the Lego from B&M Bargains, on Central Road, at Alfreton.

Prosecuting solicitor Becky Allsop said: “There was a report of a male who had been seen to place items in a bag and to leave without paying.

“That was put out over a shop radio and Wilkinson’s said a male matching his description had been in their store half-an-hour later.”

Ward, of Pickering Avenue, Nottingham, was stopped by police but the stolen property was not recovered and he said he had stolen two boxes of Lego.

The defendant pleaded guilty to the theft from July 17 and also admitted committing the offence during the operational periods of two suspended sentence orders which had been imposed for thefts.

Defence solicitor Michael Clark said Ward had struggled to get benefits due to identification problems and he had lasted as long as possible without money but eventually gave in to temptation.

A friend said he would give Ward £5 if he stole a couple of boxes of Lego which he did, according to Mr Clark, and the money was used to buy food.

Mr Clark added that Ward has been refraining from using heroin and has been taking medication and he has an established address but fears he could lose it if he is placed into custody.

Magistrates sentenced Ward to 24 weeks of custody and ordered him to pay £30 compensation.
