Chesterfield magistrates’ court heard on Thursday, March 9, how Richard Wesley, 29, of Portland Street, Whitwell, stole the goods from the Co-op, on Spring Street, Whitwell.

Prosecuting solicitor Sam Matkin said: “The incident occurred on January 21 at the Co-op after the defendant had entered with a female and the female purchased items but staff consulted CCTV because they were concerned about the male.”

Mr Matkin added that the defendant was seen taking two Cream Eggs and biscuits and did not pay for the items before he left the store.

The defendant told police he had no recollection of events but admitted what had happened after viewing the CCTV.

Wesley pleaded guilty to the theft.

Defence solicitor Kirsty Sargent said Wesley is taking six different types of medication for different physical and mental health conditions and he puts his lack of memory down to the medication.

Magistrates fined Wesley £40 and ordered him to pay £85 costs, a £30 victim surcharge and £4 compensation.
