Derbyshire pensioner caught drink driving outside own home

A Derbyshire pensioner was caught drink driving outside his own house as he returned from a meal out with his wife, a court heard.

Clive Kavulok, 76, of Windsor Drive, Dronfield Woodhouse, was spotted by police on Windsor Drive on December 20 and they breathalysed him on his drive.

Prosecuting, Becky Allsop said that Kavulok had drunk two-and-a-half pints of lager at the meal and didn’t realise it was as strong as it was.

She added that Kavulok had blown 55mg of alcohol in 100ml of breath, when the legal limit is 50.

Defending, Gavin Hague said: “This incident has brought a lot of shame onto him. The two-and-a-half pints was drunk through the course of a meal - he felt absolutely fine and thought he was okay to drive.

“He’s had a very difficult Christmas. His wife has, of last Tuesday, been taken into palliative care - she is now at a care home in Eckington and is no longer living at the matrimonial home. There is no direct bus and he is having to rely on taxis to go and see her.He has also just been diagnosed with prostate cancer.”

Kavulok admitted drink driving and was banned from the roads for 12 months, although he was offered a drink drive rehabilitation course which would reduce the disqualification by a third if completed successfully.

He was also fined £184 and ordered to pay £85 in prosecution costs and a £32 victim surcharge.
